In so many aspects of our lives, we recognize the importance of planning ahead, whether in respect of our careers, our families or even our holidays. However, we somehow neglect to plan ahead for a time when we may no longer be here or be able to make decisions for ourselves. Unfortunately we can’t predict when death or loss of capacity might occur; it could happen at any time to any of us. It is therefore advisable for every adult to make a will to ensure that their estate ends up where they intend it to after their death. If a person makes a will before death, he dies TESTATE. Where a person dies without having made a will, he dies INTESTATE and his assets, whether personalty or realty, are given out according to the Rules of Succession as laid down by the law.

A will cannot be changed after death. The consequences of an error or misunderstanding in drafting a will can therefore be dire. This is why it is important that your wishes are fully understood and carefully recorded in a document which must satisfy a number of formalities stipulated in the Wills Act Cap 495 of the Laws of Saint Vincent and the Grenadines 2009 Revision. We ensure that the highest degree of care is exercised from the outset. We will sit with you to answer your questions, to offer advice and to take your instructions. If you are advanced in years or are unable to visit our chambers due to a disability, we will visit you at your home or an alternative place of your choosing. So much importance is attached to making a will that it is not uncommon to have a number of consultations before the will is finalized and executed.

Preparing for the eventuality of losing the ability to make your own decisions before you die is also of importance. A Power of Attorney can help. You can choose to execute a Power of Attorney enabling a person you trust to look after your finances and welfare for you during any future incapacitation you may experience due to ill-health. Without this they may have to go through an expensive, lengthy and stressful court application at an emotionally difficult time.

By the same token, we understand that bereavement is an incredibly difficult time. We help to bear some of that burden. We provide support in dealing with the paperwork no matter what the size of the estate. We handle applications for probate (where a person dies testate) and applications for letters of administration (where a person dies intestate).
